Para estos casos, el <strong>C\u00f3digo Civil<\/strong> establece que el vendedor est\u00e1 obligado a hacerse cargo de los vicios ocultos que tiene la vivienda.<\/p>\n<p>Asimismo, la <strong>Profeco<\/strong> explica que si el da\u00f1o es estructural, la garant\u00eda es por 5 a\u00f1os. Si es de impermeabilizaci\u00f3n es por 3 a\u00f1os. Y cuando se trate de otras cuestiones que s\u00ed se hayan establecido en el contrato, el tiempo es de 1 a\u00f1o.<\/p>\n<p>Leonardo Gonz\u00e1lez, <strong>analista Real Estate de <a href=\"https:\/\/propiedades.com\/\">Propiedades.com<\/a><\/strong>, considera que las garant\u00edas ofrecen un marco legal que ayudan al funcionamiento adecuado de un inmueble.<\/p>\n<h4><strong>Viviendas de segunda mano<\/strong><\/h4>\n<p>Es preciso mencionar que cuando la compraventa se lleva a cabo entre particulares, no se act\u00faa como consumidores, esto supone una diferencia en el tratamiento legal de los desperfectos ocultos. En el caso de viviendas de segunda mano, especifica el <strong>C\u00f3digo Civil<\/strong>, el plazo para reclamar los desperfectos es de 6 meses.<\/p>\n<p>Se enfatiza tambi\u00e9n en puntualizar lo que se considera como un desperfecto o \u201cvicio oculto\u201d. El <strong>C\u00f3digo Civil<\/strong>\u00a0establece que un vicio oculto radica en:<\/p>\n<ul>\n<li>Vivienda con problemas en las tuber\u00edas<\/li>\n<li>Vivienda que padezca de aluminosis<\/li>\n<li>Vivienda afectada por derramas extraordinarias como consecuencia, por ejemplo, de obras de pavimentaci\u00f3n y acerado e instalaci\u00f3n de alumbrados, siempre y cuando dicha derrama fuera objeto de aprobaci\u00f3n en junta general celebrada con anterioridad a la perfecci\u00f3n<\/li>\n<\/ul>\n<h4><strong>Si las fallas persisten<\/strong><\/h4>\n<p>Si se trata de un problema menor, el proveedor est\u00e1 obligado a realizar todas las reparaciones necesarias y entregar bonificaci\u00f3n del 5% sobre el valor de la reparaci\u00f3n.<\/p>\n<p>Pero, si es algo grave que afecte la estructura o instalaci\u00f3n de la vivienda e impida su uso, el proveedor tambi\u00e9n debe hacer las reparaciones necesarias y brindar una bonificaci\u00f3n del 20% de la cantidad
