{"id":95757,"date":"2019-09-09T08:58:50","date_gmt":"2019-09-09T13:58:50","guid":{"rendered":"https:\/\/centrourbano.com\/?p=95757"},"modified":"2019-09-30T18:24:27","modified_gmt":"2019-09-30T23:24:27","slug":"testamento-terminologia-necesaria","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/vivienda\/testamento-terminologia-necesaria\/","title":{"rendered":"Testamento: la terminolog\u00eda necesaria para otorgarlo"},"content":{"rendered":"<p><em>De acuerdo con la Secretar\u00eda de Gobernaci\u00f3n, el costo del testamento var\u00eda en cada entidad, y en algunos lugares se ofrecen descuentos a adultos mayores<\/em><!--more--><\/p>\n<p>Con un <strong>testamento<\/strong> es posible <strong>garantizar que los derechos sobre determinada propiedad se puedan trasmitir<\/strong> en forma ordenada y pac\u00edfica a quien la persona quien lo otorga decida, y, aunque puede resultar dif\u00edcil decidir a qui\u00e9n heredar el patrimonio, al hacerlo <strong>se evitan conflictos futuros a los seres queridos.<\/strong><\/p>\n<p>Adem\u00e1s, cabe mencionar que se tiene la opci\u00f3n de <strong>modificar el testamento<\/strong> cuando se desee si se cambia de opini\u00f3n.<\/p>\n<p><strong>Leonardo Gonz\u00e1lez, analista de Real Estate del portal inmobiliario <a href=\"https:\/\/propiedades.com\/\" target=\"_blank\" rel=\"noopener noreferrer\">Propiedades.com<\/a><\/strong>, destac\u00f3 que los inmuebles intestados tienen una alta probabilidad de comercializarse nuevamente a trav\u00e9s de un remate de adjudicaci\u00f3n que ser\u00e1 aprobado por un juez.<\/p>\n<p><strong>Septiembre es el \u2018Mes del Testamento\u2019<\/strong>, en el que los notarios de todo el pa\u00eds ofrecen <strong>descuentos y horarios extendidos<\/strong> para que la gente pueda acudir a realizar el suyo. De acuerdo con la <strong>Secretar\u00eda de Gobernaci\u00f3n (Segob),<\/strong> <strong>el costo del testamento var\u00eda en cada entidad<\/strong>, los precios van de los 870 pesos en Morelos a 3,000 pesos en Tlaxcala, y en algunos lugares se ofrecen descuentos a adultos mayores.<\/p>\n<p>Sin embargo, expertos sugieren que, para otorgar correctamente un testamento, es importante conocer la<strong> terminolog\u00eda que se usa con m\u00e1s frecuencia<\/strong>, es decir:<\/p>\n<ul>\n<li><strong>Testador<\/strong><\/li>\n<\/ul>\n<p>Es <strong>la persona que otorga el testamento<\/strong>, y lo que debe hacer es acudir ante el notario p\u00fablico con documentos de identificaci\u00f3n, CURP, datos generales como lugar y fecha de nacimiento, nacionalidad, ocupaci\u00f3n, domicilio y los nombres completos de su familia, incluidos padres, c\u00f3nyuge e hijos.<\/p>\n<p>El <strong>Colegio Nacional del Notariado Mexicano (CNNM)<\/strong> menciona que el testador deber\u00e1 informar si presenta alguna discapacidad visual, auditiva, motriz o del habla, y no es necesario que lleve una lista completa de sus bienes, a menos que decida dejar uno espec\u00edfico a alguna persona.<\/p>\n<p>De no haber testamento, la ley establecer\u00e1 qui\u00e9nes ser\u00e1n los herederos y en qu\u00e9 proporci\u00f3n, lo que puede provocar que la familia enfrente gastos elevados, p\u00e9rdida de tiempo y en ocasiones conflictos entre aquellas personas que consideren tener derecho a recibir los bienes.<\/p>\n<ul>\n<li><strong>Legatario<\/strong><\/li>\n<\/ul>\n<p>\u00c9sta es la <strong>persona designada para recibir alg\u00fan bien en espec\u00edfico.<\/strong> Un ejemplo de c\u00f3mo se especifica el legatario en el testamento es: \u201cDesigno legatario del terreno ubicado en (direcci\u00f3n completa) a mi sobrino (nombre)\u201d.<\/p>\n<ul>\n<li><strong>Herederos<\/strong><\/li>\n<\/ul>\n<p>Son las <strong>personas que recibir\u00e1n la totalidad de los bienes<\/strong>, derechos y obligaciones del testador. En caso de que sean dos, o m\u00e1s, es necesario mencionar la proporci\u00f3n que cada uno de ellos recibir\u00e1 de la herencia.<\/p>\n<ul>\n<li><strong>Albacea<\/strong><\/li>\n<\/ul>\n<p>Es una persona, nombrada por el testador, que <strong>se encargar\u00e1 de dar cumplimiento a lo dispuesto en el testamento.<\/strong><\/p>\n<ul>\n<li><strong>Tutores y Curadores<\/strong><\/li>\n<\/ul>\n<p>Dentro del testamento es posible nombrar <strong>tutores para menores de edad o personas que sufran alguna incapacidad<\/strong> y que sean herederos. Los tutores se encargar\u00e1n de su cuidado y el de sus bienes, y, en caso de ser necesario, ser\u00e1n sus representantes jur\u00eddicos.<\/p>\n<p>Por otro lado, el <strong>curador es la persona que se encargar\u00e1 de vigilar que el desempe\u00f1o del tutor sea el adecuado<\/strong>, y si considera que es perjudicial para los menores deber\u00e1 notificarlo ante un
