{"id":86744,"date":"2019-02-21T18:53:44","date_gmt":"2019-02-22T00:53:44","guid":{"rendered":"https:\/\/centrourbano.com\/?p=86744"},"modified":"2019-02-21T18:53:44","modified_gmt":"2019-02-22T00:53:44","slug":"evitar-fraudes-inmobiliarios","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/opinion\/evitar-fraudes-inmobiliarios\/","title":{"rendered":"\u00bfC\u00f3mo evitar fraudes inmobiliarios?"},"content":{"rendered":"<p><strong>Por Colegio Nacional del Notariado Mexicano<\/strong><!--more--><\/p>\n<p>Si este a\u00f1o uno de tus planes es comprar un inmueble, es muy importante que sigas los consejos del <strong>Colegio Nacional del Notariado Mexicano<\/strong> para evitar ser v\u00edctima de un fraude inmobiliario:<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Antes de la compraventa: <\/strong><\/p>\n<ol>\n<li>Busca asesor\u00eda de un notario. Antes de firmar cualquier contrato, o comprometerte a la compra de cualquier forma, contacta a tu notario de confianza. El notario puede confirmar ciertos aspectos b\u00e1sicos del inmueble antes de realizar la compraventa, por ejemplo:<\/li>\n<\/ol>\n<ul>\n<li>Que la persona que vende el inmueble realmente sea el due\u00f1o y si es un \u00fanico due\u00f1o o deber\u00e1 obtenerse el consentimiento de otros due\u00f1os para la compraventa, por ejemplo, la esposa si est\u00e1 casado por sociedad conyugal.<\/li>\n<li>Que no exista un juicio testamentario inconcluso.<\/li>\n<li>Que la propiedad no tenga una hipoteca.<\/li>\n<\/ul>\n<ol start=\"2\">\n<li>Revisa la situaci\u00f3n jur\u00eddica del inmueble. El notario, dependiendo de la legislaci\u00f3n local, tramitar\u00e1 las constancias que acrediten que el inmueble est\u00e1 libre de grav\u00e1menes y al corriente en el pago de sus contribuciones, tales como predial y agua.<\/li>\n<li>Aseg\u00farate de que los agentes inmobiliarios sean aut\u00e9nticos y confiables. Los agentes o agencias de bienes ra\u00edces deben registrar su contrato de adhesi\u00f3n frente a la Procuradur\u00eda Federal del Consumidor (Profeco) para poder comercializar una vivienda. Es importante cerciorarse de que exista este registro.<\/li>\n<li>Investiga al desarrollador inmobiliario. Si vas a comprar vivienda en una preventa, investiga si existen quejas en la Profeco por retraso en la entrega y en el cumplimiento de compromisos. Podr\u00e1s encontrar el listado de compa\u00f1\u00edas y servicios inmobiliarios que han recibido quejas en burocomercial.profeco.gob.mx. Revisa tambi\u00e9n los permisos y licencias de construcci\u00f3n.<\/li>\n<li>Aseg\u00farate de la identidad del vendedor. Pide ayuda a tu notario para que se asegure de la identidad del comprador. No obstante que \u00e9l tomar\u00e1 las medidas se\u00f1aladas por la ley, es importante no escatimar en precauciones pues existen casos en los que las personas \u201croban\u201d una identidad y obtienen mediante falsificaci\u00f3n y\/o enga\u00f1o acta de nacimiento, curp e identificaciones oficiales, tales como credencial para votar, licencia de manejo o pasaporte; pueden lograr enga\u00f1ar incluso a notarios y autoridades. Por ello es importante obtener las mayores referencias posibles.<\/li>\n<li>Ten cuidado con la adquisici\u00f3n de terrenos vac\u00edos pues son los favoritos de los defraudadores. Investiga c\u00f3mo, cu\u00e1ndo y bajo qu\u00e9 circunstancias adquiri\u00f3 tu vendedor, haz todos los pagos con cheques para abono en cuenta o transferencias y aseg\u00farate de que tenga una oficina o un lugar d\u00f3nde se le pueda localizar.<\/li>\n<li>Comprueba el estado real del inmueble. Lleva un especialista que pueda revisar el estado de las tuber\u00edas, el cableado el\u00e9ctrico y las instalaciones de gas para evitar as\u00ed vicios ocultos.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><strong>Durante la compraventa: <\/strong><\/p>\n<ol start=\"8\">\n<li>Escritura la propiedad lo antes posible, de preferencia al hacer el pago. La escrituraci\u00f3n es la forma m\u00e1s segura de comprobar la propiedad de un inmueble. No escriturar es riesgoso puesto que los contratos privados o poderes no son soluciones a largo plazo; por ejemplo, la muerte del poderdante o del apoderado da por concluido el poder.<\/li>\n<li>Utiliza formas de pago seguras. Las transferencias o cheques certificados son las formas m\u00e1s seguras. Pide tambi\u00e9n asesor\u00eda de tu notario.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><strong>Despu\u00e9s de la compraventa: <\/strong><\/p>\n<ol start=\"10\">\n<li>Ocupa el terreno o inmueble. Dejar desocupado un terreno o inmueble por largo tiempo incrementa sustancialmente el riesgo de verse sujeto a un fraude.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p>El notario es tu mejor aliado para proteger tu inmueble, acude a \u00e9l para obtener informaci\u00f3n de c\u00f3mo realizar una compaventa segura o revisar la situaci\u00f3n actual de tu patrimonio.
