{"id":75400,"date":"2018-07-31T12:27:50","date_gmt":"2018-07-31T17:27:50","guid":{"rendered":"https:\/\/centrourbano.com\/?p=75400"},"modified":"2018-07-31T12:31:32","modified_gmt":"2018-07-31T17:31:32","slug":"blockchain-notariado-materia-inmobiliaria","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/opinion\/blockchain-notariado-materia-inmobiliaria\/","title":{"rendered":"El blockchain y el notariado en materia inmobiliaria"},"content":{"rendered":"<p><strong>Por Notario Jos\u00e9 Antonio Manzanero Escutia<\/strong><!--more--><\/p>\n<p>Los avances tecnol\u00f3gicos han impactado todas las \u00e1reas del quehacer humano y la actividad notarial no pod\u00eda quedarse atr\u00e1s como depositaria de la fe p\u00fablica y experto legal que brinda asesor\u00eda en materia inmobiliaria y otros temas.<\/p>\n<p>El notariado nacional ha estado siempre de acuerdo con modernizar el ejercicio de la funci\u00f3n a trav\u00e9s de herramientas tecnol\u00f3gicas que faciliten a los mexicanos el acceso o la realizaci\u00f3n de tr\u00e1mites, siempre y cuando se cuide la seguridad y certeza jur\u00eddicas y sin soslayar ni vulnerar los principios rectores de la funci\u00f3n notarial.<\/p>\n<p>Prueba de ello es que en la actualidad los reportes sobre diversas operaciones, entre ellas las de venta o adquisiciones de inmuebles, que presentamos los notarios ante el <strong>Servicio de Administraci\u00f3n Tributaria<\/strong> en materia inmobiliaria se realizan a trav\u00e9s del <strong>Declaranot<\/strong>, un portal creado para este fin por la <strong>Secretar\u00eda de Hacienda y Cr\u00e9dito P\u00fablico<\/strong>.<\/p>\n<p>Asimismo, a trav\u00e9s de medios telem\u00e1ticos el notariado, los desarrolladores inmobiliarios, agentes inmobiliarios y otros profesionales que desarrollamos actividades vulnerables presentamos ante la <strong>Unidad de Inteligencia Financiera<\/strong> los avisos en materia de lavado de dinero.<\/p>\n<p>Sin embargo, de acuerdo con el notario <strong>Jos\u00e9 Antonio M\u00e1rquez Gonz\u00e1lez<\/strong>, quien hace un an\u00e1lisis del estudio del Dr. Dominik Gassen, algunas tecnolog\u00edas emergentes, como el <strong>blockchain<\/strong> y los <strong>smart contracts<\/strong>, presentar\u00e1n en los pr\u00f3ximos a\u00f1os nuevos retos para la actividad notarial. Perm\u00edtanme explicar por qu\u00e9:<\/p>\n<p>El blockchain ha sido descrita como una tecnolog\u00eda capaz de proveer cierto grado de confianza en ambientes electr\u00f3nicos, algunos consideran que tiene el potencial de transformar la manera en la que actualmente se compran y venden los inmuebles eliminando fraudes e incrementando la transparencia.<\/p>\n<a href=\"https:\/\/centrourbano.com\/revista\/wp-content\/uploads\/blockchain.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-75401 aligncenter\" src=\"https:\/\/centrourbano.com\/revista\/wp-content\/uploads\/blockchain.jpg\" alt=\"\" width=\"578\" height=\"347\" srcset=\"https:\/\/centrourbano.com\/revista\/wp-content\/uploads\/blockchain.jpg 578w, https:\/\/centrourbano.com\/revista\/wp-content\/uploads\/blockchain-300x180.jpg 300w\" sizes=\"auto, (max-width: 578px) 100vw, 578px\" \/><\/a>\n<p>Pongamos un ejemplo, con la tecnolog\u00eda blockchain el comprador de un inmueble tendr\u00e1 la confianza de que su dinero ser\u00e1 transferido en forma totalmente segura y oportuna al vendedor, bajo la seguridad de que la persona que vende realmente es el titular del inmueble, a trav\u00e9s de un sistema de acopio de datos de los registros inmobiliarios. Esto es posible porque el sistema blockchain sucede en un ambiente tecnol\u00f3gico en el que diferentes bloques de informaci\u00f3n se encadenan, lo que lo hace casi absolutamente imposible de intervenir o alterar.<\/p>\n<p>Los smart contracts funcionan de otra manera. El concepto b\u00e1sico es que los contratos entre particulares pueden ser tratados como programas de c\u00f3mputo que se ejecutan autom\u00e1ticamente una vez que ciertas condiciones t\u00e9cnicas han sido satisfechas. Estas condiciones t\u00e9cnicas est\u00e1n conectadas entre s\u00ed por sistemas aut\u00f3nomos, por ejemplo, para la venta por remate judicial de una casa diversas instituciones, como las autoridades judiciales, los bancos y los registros p\u00fablicos, deber\u00edan estar en coordinaci\u00f3n para habilitar diferentes aspectos de la venta.<\/p>\n<p>\u00bfCuestionan estas tecnolog\u00edas el papel del notario? Primero que nada, quisiera advertir que una de las principales tareas del notario es dar asesor\u00eda a las partes, esta actividad no podr\u00e1 ser sustituida por una tecnolog\u00eda. Los notarios intervenimos en materia inmobiliaria en asuntos de diversa complejidad, entre ellos los fideicomisos, sucesiones, donaciones, usufructos, entre muchos otros, que no pueden ser resueltos en forma automatizada.<\/p>\n<p>En segundo lugar, estas tecnolog\u00edas est\u00e1n todav\u00eda en proceso de maduraci\u00f3n, lo que nos hace imposible calcular a\u00fan su grado de efectividad.<\/p>\n<p>Por \u00faltimo, las caracter\u00edsticas y naturaleza de la funci\u00f3n notarial a la luz del sistema jur\u00eddico mexicano actual exigen y demandan una serie de acciones que, no obstante ser de naturaleza personal y presencial, puede verse enriquecida por estos sistemas y la certeza y seguridad que los mismos generen.<\/p>\n<p>Podemos concluir que no existe forma real de predecir qu\u00e9 cambios impulsar\u00e1n estas tecnolog\u00edas y de qu\u00e9 manera impactar\u00e1n las transacciones inmobiliarias. Desde mi punto de vista, la asesor\u00eda legal del notario y su consejo en la vida patrimonial seguir\u00e1n siendo relevantes para dar certeza y seguridad jur\u00eddica; y cualquier tecnolog\u00eda
