{"id":45782,"date":"2016-12-22T12:29:50","date_gmt":"2016-12-22T18:29:50","guid":{"rendered":"https:\/\/centrourbano.com\/?p=45782"},"modified":"2016-12-22T12:35:41","modified_gmt":"2016-12-22T18:35:41","slug":"vetan-decreto-impuesto-hospedaje","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/inmobiliario\/vetan-decreto-impuesto-hospedaje\/","title":{"rendered":"Vetan decreto de Impuesto sobre Hospedaje"},"content":{"rendered":"<p><em>Poder estatal de Nuevo Le\u00f3n consider\u00f3 que el Congreso local transgrede funciones<\/em><br \/>\n<!--more--><\/p>\n<p>El gobierno de Nuevo Le\u00f3n vet\u00f3 el Decreto 180, a trav\u00e9s del cual el Congreso local propon\u00eda determinar el destino de la recaudaci\u00f3n del Impuesto sobre Hospedaje, por medio del Fideicomiso Turismo Nuevo Le\u00f3n.<\/p>\n<p>En un comunicado estatal, se explica que el Estado considera que el Congreso transgrede divisi\u00f3n de Poderes al pretender determinar el destino de los recursos recaudados.<\/p>\n<p>\u201cEn el documento entregado al Congreso informando de la devoluci\u00f3n del Decreto, se se\u00f1ala que establecer el destino de los ingresos generados por el cobro del Impuesto es competencia del Ejecutivo\u201d. <\/p>\n<p>Esto debido a que no hay fundamento constitucional que permita al Congreso del Estado ejercer la funci\u00f3n administrativa y con ello afectar el \u00e1mbito de competencia del Ejecutivo. La propuesta del Legislativo se contrapone tambi\u00e9n a lo establecido en el contrato que da origen al Fideicomiso Turismo Nuevo Le\u00f3n.<\/p>\n<p>Y es que seg\u00fan el gobierno estatal, \u00e9ste solo puede hacer los gastos cuyo monto y finalidad se encuentren contemplados en el Presupuesto de Egresos y no en un documento diferente emitido en forma posterior, que ser\u00eda el caso del Decreto mencionado.<\/p>\n<p>Este a\u00f1o se realizaron 11 sesiones ordinarias, en las que el Comit\u00e9 T\u00e9cnico del Fideicomiso, integrado por representantes del Gobierno del Estado, de la Asociaci\u00f3n Mexicana de Hoteles y Moteles de Nuevo Le\u00f3n y de la C\u00e1mara Nacional de Comercio de Monterrey, autoriz\u00f3 apoyos a 73 eventos por un monto de 43,753,000 de pesos. <\/p>\n<p>De estos proyectos, 17 corresponden al presente a\u00f1o; 45 est\u00e1n programados para el a\u00f1o entrante; 7 para 2018; 3 para 2019 y 1 para 2020.<br \/>\n\u201cDebido a la falta de proyectos tur\u00edsticos, este a\u00f1o habr\u00e1 un subejercicio de 24,330,247 pesos de los recursos recaudados por concepto de Impuesto al Hospedaje.<\/p>\n<p>\u201cEsta cantidad se concentrar\u00e1 en la Secretar\u00eda de Finanzas y Tesorer\u00eda General del Estado y se destinar\u00e1 a otros programas establecidos en el Plan Estatal de Desarrollo, de conformidad con la Ley de
