Ahora bien, \u00bfqu\u00e9 pasa con aqu\u00e9llos tr\u00e1mites que implican la participaci\u00f3n de un notario y est\u00e1n directamente relacionados con nuestros bienes? \u00bfEs cierto que son complejos, caros o innecesarios?<\/p>\n<p>Perm\u00edtame responderle presentando los mitos m\u00e1s comunes respecto a la protecci\u00f3n de nuestro patrimonio:<\/p>\n<p><b>MITO:<\/b> Escriturar una casa o un departamento es muy caro, es mejor quedarse con un contrato privado o con un poder notarial.<\/p>\n<p><b>REALIDAD:<\/b> De ninguna manera. Para la mayor parte de las familias comprar una casa representa la inversi\u00f3n de todos sus ahorros y, en muchas ocasiones, el patrimonio m\u00e1s importante de su vida; no escriturar resulta mucho m\u00e1s caro puesto que los contratos privados y los poderes notariales no son soluciones a largo plazo y conllevan grandes riesgos para el comprador; por ejemplo, la muerte del vendedor da por concluido el poder, lo que implicar\u00eda que a la muerte del vendedor tendr\u00edamos que iniciar un juicio para probar la posesi\u00f3n y con eso la propiedad.<\/p>\n<p>Actualmente, en la zona metropolitana el costo de la escritura de compraventa de una vivienda oscila entre el 4 y 7 por ciento del valor total de la propiedad. La mayor proporci\u00f3n de este costo son impuestos y derechos que el Notario retiene y tiene que pagar al fisco.<\/p>\n<p>La escrituraci\u00f3n de un inmueble es la \u00fanica forma en la que tendremos la certeza jur\u00eddica de la propiedad ante terceros, incluyendo los bancos para contratar cr\u00e9ditos con garant\u00eda hipotecaria.<\/p>\n<p><b>MITO:<\/b> Cuando una persona est\u00e1 pagando el cr\u00e9dito de su casa a un organismo de vivienda o a un banco, la propiedad la tiene el organismo o el banco hasta que se termina de pagar.<\/p>\n<p><b>REALIDAD:<\/b> Falso. La propiedad le pertenece al due\u00f1o de la vivienda con la caracter\u00edstica de que la misma est\u00e1 hipotecada a favor del organismo o del banco, as\u00ed que conviene otorgar testamento para proteger el patrimonio.<\/p>\n<p>Septiembre es el mes del testamento a nivel nacional por acuerdo de la Secretar\u00eda de Gobernaci\u00f3n y el Colegio Nacional del Notariado Mexicano. Durante este mes los Notarios de todo el pa\u00eds reducimos nuestros honorarios hasta en 50 por ciento y ampliamos nuestros horarios de atenci\u00f3n para facilitar que los mexicanos regularicen su voluntad.<\/p>\n<p><b>MITO:<\/b> Como ya existe la Ley contra el lavado de dinero ninguna casa o departamento se puede comprar pagando en efectivo.<\/p>\n<p><b>REALIDAD:<\/b> De hecho, la Ley establece como l\u00edmite para entregar dinero en efectivo cuando se compra una vivienda la cantidad de 8,025 veces el salario m\u00ednimo del Distrito Federal, elevado al a\u00f1o, lo que en n\u00fameros redondos equivale a $54,000.00; de manera que si el precio es superior a esa cantidad, el resto del dinero deber\u00e1 pagarse con alg\u00fan instrumento financiero, como puede ser cheque de caja, cheque certificado o transferencia bancaria.<\/p>\n<p>Es importante recordar que el Notario es la persona m\u00e1s adecuada para proveer consejo legal gratuito, por lo tanto, acudir al Notario es la v\u00eda m\u00e1s sencilla para obtener informaci\u00f3n de c\u00f3mo proteger nuestro patrimonio.<\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: right;\"><em><b>COLABORACI\u00d3N ESPECIAL <\/b><\/em><\/p>\n<p style=\"text-align: right;\"><em><b>*<\/b>Presidente del Colegio Nacional del Notariado Mexicano<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Por\u00a0Javier P\u00e9rez Almaraz*<\/p>\n","protected":false},"author":14,"featured_media":0,"comment_status":"open","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"om_disable_all_campaigns":false,"inline_featured_image":false,"_monsterinsights_skip_tracking":false,"_monsterinsights_sitenote_active":false,"_monsterinsights_sitenote_note":"","_monsterinsights_sitenote_category":0,"footnotes":""},"categories":[242,5],"tags":[],"class_list":["post-4487","post","type-post","status-publish","format-standard","hentry","category-blog-de-invitado","category-opinion"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Mitos y Realidades: \u00bfC\u00f3mo proteger tu patrimonio?
