{"id":26827,"date":"2015-12-09T18:29:37","date_gmt":"2015-12-10T00:29:37","guid":{"rendered":"http:\/\/centrourbano.com\/?p=26827"},"modified":"2015-12-09T18:43:38","modified_gmt":"2015-12-10T00:43:38","slug":"el-traspaso-de-inmuebles","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/opinion\/el-traspaso-de-inmuebles\/","title":{"rendered":"El traspaso de inmuebles"},"content":{"rendered":"<p><strong>Por: Notario H\u00e9ctor Galeano Incl\u00e1n*<\/strong><em><\/p>\n<p>Cuando una persona adquiere un Bien Inmueble a cr\u00e9dito se celebran 3 actos jur\u00eddicos: el primero es el contrato de compraventa del inmueble, segundo el contrato de cr\u00e9dito y, por \u00faltimo, la garant\u00eda hipotecaria sobre el inmueble adquirido.<\/p>\n<p>Es muy com\u00fan que despu\u00e9s de alg\u00fan tiempo, esa persona desea vender su propiedad y entonces hay \u201calguien\u201d que desea adquirir dicho bien bajo un esquema que coloquialmente se conoce como \u201ctraspaso\u201d.<\/p>\n<p>La persona que tiene un cr\u00e9dito hipotecario fue sujeto de una investigaci\u00f3n detallada y minuciosa de su perfil y capacidad econ\u00f3mica con la finalidad de asegurar su solvencia y, por supuesto, de que pagar\u00e1 la deuda contra\u00edda.<\/p>\n<p>Normalmente en todo contrato de cr\u00e9dito se se\u00f1ala como causal de rescisi\u00f3n y de vencimiento anticipado del mismo el que se ceda o traspase dicho cr\u00e9dito. Esto significa que no es posible ceder, vender, traspasar o de cualquier forma enajenar un inmueble que garantiza el pago de un cr\u00e9dito, salvo que se tenga la autorizaci\u00f3n del acreedor. <\/p>\n<p>\u00bfQu\u00e9 hacer en estos casos? <\/p>\n<p>Lo que debiera hacerse es poner al tanto a nuestro posible comprador acerca de la existencia de esa deuda y de la garant\u00eda hipotecaria existente. Lo recomendado ser\u00eda ponerse en contacto con la Instituci\u00f3n acreedora para plantearle y solicitarle cualquiera de las siguientes alternativas:<\/p>\n<p>1.- Que el comprador desea continuar pagando el cr\u00e9dito subsistiendo su correspondiente garant\u00eda hipotecaria. En este supuesto, si el acreedor acepta como nuevo deudor al posible comprador, se instruir\u00e1 a un Notario P\u00fablico para que ante su fe se otorgue, la escritura de compraventa y su correspondiente, reconocimiento de adeudo y sustituci\u00f3n de deudor. Evidentemente habr\u00e1 que analizar y estudiar las seguramente nuevas condiciones crediticias, bajo las cuales la instituci\u00f3n acreedora acepte al nuevo deudor.<\/p>\n<p>2.- Una segunda opci\u00f3n es cuando se piensa liquidar la totalidad del cr\u00e9dito originalmente otorgado. Se acostumbra que el deudor pida un corte\/saldo del cr\u00e9dito contratado a cierta fecha para estar en posibilidad de pagar el mismo; efectuar el contrato de compraventa ante notario y simult\u00e1neamente cancelar tambi\u00e9n en instrumento p\u00fablico la hipoteca.<\/p>\n<p>En la pr\u00e1ctica algunos no hacen lo anteriormente detallado y firman entre las partes contratantes contratos privados de compraventa; o bien se otorgan poderes limitados e irrevocables; o siguen pagando de manera \u201cirregular\u201d el cr\u00e9dito para al final de esta acci\u00f3n escriturar a favor del comprador o de un tercero.<\/p>\n<p>Todo esto acarrea importantes, delicados y graves vicios y riesgos de \u00edndole jur\u00eddico en materia civil, fiscal y administrativa. \u00a1No propicies ni fomentes la irregularidad.
