Las multas por incumplimiento pueden alcanzar hasta un mill\u00f3n de pesos<\/em><\/p>\n<p><!--more--><\/p>\n<p>Con la entrada en vigor de la nueva <a href=\"https:\/\/centrourbano.com\/revista\/inmobiliario\/reforma-a-la-ley-antilavado-impone-nuevas-obligaciones-al-sector-inmobiliario\/\" target=\"_blank\" rel=\"noopener\">Ley Antilavado<\/a> el pasado 17 de julio, el sector inmobiliario mexicano entra en una<strong> etapa de mayor control y vigilancia.<\/strong> La normativa establece nuevas obligaciones para los asesores y endurece las sanciones en caso de incumplimiento.<\/p>\n<p>Durante el webinar El Impacto de la Nueva Ley Antilavado en el Sector Inmobiliario este 2025, Jorge Rodr\u00edguez, Business Development Manager en Regcheq M\u00e9xico, explic\u00f3 que la principal modificaci\u00f3n est\u00e1 relacionada con la incorporaci\u00f3n de los asesores a la primera l\u00ednea de prevenci\u00f3n. Ahora deber\u00e1n evaluar a los posibles compradores, integrar expedientes y emitir alertas cuando detecten indicios de riesgo.<\/p>\n<blockquote><p>\u201cDesde 2012 exist\u00edan algunas disposiciones, pero eran poco revisadas. Hoy, los brokers comparten responsabilidad con notarios y deber\u00e1n conocer a fondo a sus clientes, crear expedientes y notificar cualquier indicio de operaci\u00f3n sospechosa o irregularidad\u201d, se\u00f1al\u00f3 Rodr\u00edguez.<\/p><\/blockquote>\n<h2>Cambios en la Ley Antilavado<\/h2>\n<p>Entre las nuevas disposiciones, los asesores deber\u00e1n validar la identidad de los compradores, verificar su fuente de ingresos y asegurarse de que no figuren en listas de vigilancia. La ley tambi\u00e9n incorpora la figura del <strong>Beneficiario Controlador<\/strong>, que obliga a identificar a la persona que posea o controle al menos 25% de una empresa participante en una operaci\u00f3n inmobiliaria.<\/p>\n<p>Otro cambio relevante es la <strong>Evaluaci\u00f3n Formal de Riesgo<\/strong>, que exige determinar si el cliente representa un nivel de riesgo bajo, medio o alto. Este an\u00e1lisis deber\u00e1 considerar la forma de pago, el origen de los recursos, la nacionalidad del comprador y su posible exposici\u00f3n pol\u00edtica.<\/p>\n<p>Adem\u00e1s, los asesores deber\u00e1n notificar al SAT y a la Unidad de Inteligencia Financiera (UIF) en un plazo m\u00e1ximo de 24 horas cuando se detecten operaciones vulnerables o comportamientos sospechosos. Tambi\u00e9n estar\u00e1n obligados a conservar los expedientes de sus clientes durante al menos diez a\u00f1os y establecer pol\u00edticas internas, manuales de cumplimiento y programas de capacitaci\u00f3n.<\/p>\n<p>Santiago Morales, CEO de MoradaUno, advirti\u00f3 que el cumplimiento representar\u00e1 un <strong>reto operativo para las agencias y profesionales del sector. <\/strong><\/p>\n<blockquote><p>\u201cEl reto no es solo legal, sino operativo. \u00bfC\u00f3mo cumplir sin detener las ventas? El momento de prepararse es ahora, porque las reglas generales salen en los pr\u00f3ximos meses y cuando eso ocurra, la autoridad podr\u00e1 empezar a revisar con todo\u201d, apunt\u00f3.<\/p><\/blockquote>\n<p>Las <strong>sanciones por incumplir la ley pueden ir desde los 20,000 hasta un mill\u00f3n de pesos<\/strong>, con posibilidad de acumulaci\u00f3n por infracciones como no presentar avisos, omitir la identificaci\u00f3n del cliente o entregar reportes incompletos.<\/p>\n<p>Rodr\u00edguez destac\u00f3 que el prop\u00f3sito de la reforma <strong>no es castigar al gremio, sino fortalecer la cooperaci\u00f3n entre el sector <\/strong>y las autoridades. \u201cEl objetivo no es convertir a los asesores en polic\u00edas, sino en aliados de la prevenci\u00f3n\u201d.<\/p>\n<p>Para Morales, los cambios deben asumirse como <strong>una oportunidad para fortalecer la profesionalizaci\u00f3n del sector. <\/strong><\/p>\n<blockquote><p>\u201cEn MoradaUno abrimos estos espacios de di\u00e1logo para ofrecer informaci\u00f3n de valor y desmitificar temas complejos. Es importante no perder de vista que hay multas serias de no acatar las disposiciones, que pueden escalar. La nueva Ley Antilavado ya es una obligaci\u00f3n, pero no es para volvernos locos: su implementaci\u00f3n es factible y marcar\u00e1 la nueva forma de operar en el sector inmobiliario\u201d, concluy\u00f3.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>La nueva Ley Antilavado busca evaluar a compradores, validar fuentes de ingreso y reportar operaciones sospechosas.
