{"id":158026,"date":"2025-10-06T13:58:12","date_gmt":"2025-10-06T19:58:12","guid":{"rendered":"https:\/\/centrourbano.com\/revista\/?p=158026"},"modified":"2025-10-06T13:58:12","modified_gmt":"2025-10-06T19:58:12","slug":"ley-de-amparo-inversion-inmobiliaria-adi","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/inmobiliario\/ley-de-amparo-inversion-inmobiliaria-adi\/","title":{"rendered":"Ley de Amparo podr\u00eda afectar la inversi\u00f3n inmobiliaria: ADI"},"content":{"rendered":"<p><em>ADI advierte que las reformas a la Ley de Amparo podr\u00edan generar desventajas competitivas y desincentivar la inversi\u00f3n inmobiliaria<\/em><!--more--><\/p>\n<p>La Asociaci\u00f3n de Desarrolladores Inmobiliarios (ADI) manifest\u00f3 su <strong>preocupaci\u00f3n ante las reformas propuestas a la Ley de Amparo<\/strong>, al considerar que podr\u00edan afectar a los inversionistas y desarrolladores del sector.<\/p>\n<p>Aunque la ADI reconoce la<strong> importancia de contar con un marco jur\u00eddico <\/strong>que brinde certeza al desarrollo de proyectos de inversi\u00f3n, expres\u00f3 su inquietud por las propuestas que limitan la procedencia de las suspensiones, restringen los efectos de las resoluciones judiciales y establecen un art\u00edculo transitorio con <strong>efectos retroactivos<\/strong>.<\/p>\n<blockquote><p>\u201cEste \u00faltimo representa un grave riesgo, ya que podr\u00eda afectar directamente a inversionistas y desarrolladores que hoy tienen juicios de amparo en curso, vulnerando el principio constitucional de no retroactividad de la ley\u201d, se\u00f1al\u00f3 la Asociaci\u00f3n.<\/p><\/blockquote>\n<p>La <a href=\"https:\/\/centrourbano.com\/revista\/vivienda\/adi-propuestas-reforzar-bando-1\/\" target=\"_blank\" rel=\"noopener\">ADI<\/a> subray\u00f3 que el sector inmobiliario es uno de los \u201cm\u00e1s sensibles a los cambios regulatorios\u201d, sobre todo en temas relacionados con permisos, usos de suelo, densidades y normativas ambientales. Por ello, advirti\u00f3 que <strong>esta reforma podr\u00eda desincentivar la inversi\u00f3n inmobiliaria.<\/strong><\/p>\n<blockquote><p>\u201cLimitar el alcance de la suspensi\u00f3n en el amparo implica dejar a los desarrolladores sin una defensa efectiva frente a posibles arbitrariedades, generando desventajas competitivas entre proyectos similares y debilitando la confianza de los inversionistas\u201d, se\u00f1al\u00f3.<\/p><\/blockquote>\n<p>La Asociaci\u00f3n a\u00f1adi\u00f3 que la aplicaci\u00f3n inmediata de las normas expone a los proyectos a sobrecostos, retrasos y modificaciones que comprometen su viabilidad financiera, lo que <strong>podr\u00eda reducir la oferta de vivienda e infraestructura.<\/strong><\/p>\n<blockquote><p>\u201cLa incertidumbre jur\u00eddica obligar\u00eda incluso a renegociar contratos con inversionistas y clientes, elevando los riesgos financieros y trasladando posibles incrementos de precios al consumidor final\u201d, apunt\u00f3.<\/p><\/blockquote>\n<p>En ese contexto, la ADI exhort\u00f3 a las autoridades a considerar las afectaciones que podr\u00eda generar la reforma, as\u00ed como las implicaciones de sus disposiciones retroactivas.<\/p>\n<blockquote><p>\u201cLa ADI hace un llamado firme y respetuoso al Poder Legislativo para que, en la discusi\u00f3n de esta reforma, se preserve no solo el equilibrio entre el inter\u00e9s p\u00fablico y la protecci\u00f3n efectiva de los derechos de los particulares, sino tambi\u00e9n el principio de no retroactividad de la ley, como garant\u00eda fundamental del Estado de derecho\u201d, afirm\u00f3.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>ADI advierte que las reformas a la Ley de Amparo podr\u00edan generar desventajas competitivas
