La NOM 247 fija obligaciones para agentes, brokers y promotores en operaciones de compraventa de casa habitaci\u00f3n en M\u00e9xico<\/em><\/p>\n

Con el objetivo de garantizar transparencia y proteger a los consumidores en las operaciones de compraventa de vivienda<\/strong>, la Norma Oficial Mexicana NOM-247-SE-2021<\/strong> se ha consolidado como un instrumento regulador fundamental en la industria inmobiliaria.<\/p>\n

La norma establece los requisitos de informaci\u00f3n comercial y publicidad<\/strong> que deben cumplir quienes comercializan inmuebles destinados a casa habitaci\u00f3n. Asimismo, fija los elementos m\u00ednimos que deben contener los contratos de adhesi\u00f3n<\/strong> para asegurar que las transacciones se realicen bajo condiciones claras y verificables.<\/p>\n

Un marco para la transparencia inmobiliaria<\/strong><\/h2>\n

La creaci\u00f3n de la NOM 247<\/strong> respondi\u00f3 a la necesidad de establecer buenas pr\u00e1cticas que garanticen operaciones seguras y confiables en el sector. Esta normativa se aplica a todas las personas f\u00edsicas o morales que intervienen en la compraventa de vivienda<\/strong>, incluidos agentes inmobiliarios, brokers, promotores y desarrolladores.<\/p>\n

Obligaciones de proveedores y comercializadores<\/strong><\/h2>\n

Entre los puntos principales de la NOM 247<\/strong> se establece que:<\/p>\n

  • Los proveedores deben poner a disposici\u00f3n de los consumidores el plan ejecutivo del proyecto, ya sea f\u00edsico o digital.<\/li>\n
  • La publicidad utilizada debe ser veraz y comprobable.<\/li>\n
  • Los precios, garant\u00edas, plazos, calidades y condiciones ofrecidas deben respetarse.<\/li>\n
  • Est\u00e1 prohibido negar informaci\u00f3n sobre un inmueble o publicar anuncios que desacrediten a otras marcas o instituciones.<\/li>\n
  • Se debe informar con total transparencia sobre la fecha de construcci\u00f3n, materiales utilizados y el estado legal actual de la vivienda.<\/li>\n<\/ul>\n

    Contratos de compraventa m\u00e1s claros<\/strong><\/h2>\n

    La NOM<\/strong> tambi\u00e9n define los elementos m\u00ednimos que deben contener los contratos de compraventa de vivienda, entre ellos:<\/p>\n

      \n
    • Fecha y lugar de celebraci\u00f3n.<\/li>\n
    • Nombre, domicilio y RFC de las partes.<\/li>\n
    • Descripci\u00f3n precisa del inmueble.<\/li>\n
    • Precio ofrecido y posibles variaciones al cierre de la transacci\u00f3n.<\/li>\n
    • Derechos y obligaciones de las partes.<\/li>\n
    • Documentaci\u00f3n que acredita la facultad de intermediaci\u00f3n.<\/li>\n
    • Condiciones de entrega y formas de pago.<\/li>\n<\/ul>\n

      Una herramienta contra fraudes inmobiliarios<\/strong><\/h2>\n

      Al estandarizar las pr\u00e1cticas y hacer obligatoria la transparencia en contratos y publicidad, la NOM 247<\/strong> busca reducir riesgos de fraude y dar mayor certeza jur\u00eddica a los compradores.<\/p>\n
