{"id":157004,"date":"2025-08-11T16:42:07","date_gmt":"2025-08-11T22:42:07","guid":{"rendered":"https:\/\/centrourbano.com\/revista\/?p=157004"},"modified":"2025-08-11T23:28:18","modified_gmt":"2025-08-12T05:28:18","slug":"cdmx-ley-inquilinaria-hic-al-propuestas","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/vivienda\/cdmx-ley-inquilinaria-hic-al-propuestas\/","title":{"rendered":"CDMX necesita una Ley Inquilinaria: HIC-AL presenta propuestas"},"content":{"rendered":"<p><em>HIC-AL propone generar contratos que aseguren el arraigo, tope al costo de las rentas, uso de viviendas vac\u00edas para alquiler, entre otras <\/em><!--more--><\/p>\n<p>A trav\u00e9s del <a href=\"https:\/\/centrourbano.com\/revista\/?s=bando+1\" target=\"_blank\" rel=\"noopener\"><strong>Bando 1<\/strong><\/a>, el Gobierno de la Ciudad de M\u00e9xico propone una <strong>Ley de Rentas Justas<\/strong>, Razonables y Asequibles; sin embargo, a\u00fan no se han sido establecidos los puntos que la conformar\u00edan.<\/p>\n<p>No obstante, la\u00a0Coalici\u00f3n Internacional para el H\u00e1bitat- Am\u00e9rica Latina\u00a0(HIC-AL), en conjunto con la UPREZ y la Plataforma 06600 de la Ju\u00e1rez, trabaja en el <strong>dise\u00f1o de una Ley Inquilinaria<\/strong> que busca garantizar <strong>seguridad, justicia y estabilidad a los arrendatarios <\/strong>en la ciudad.<\/p>\n<p>HIC-AL se\u00f1al\u00f3 que, actualmente, la <strong>mitad de los hogares con los menores ingresos rentan su vivienda<\/strong>, mientras que, el 90% de las ganancias a nivel nacional por alquiler est\u00e1 concentrado en el 10% m\u00e1s rico.<\/p>\n<p>En ese contexto, la coalici\u00f3n se\u00f1ala que las <strong>disposiciones actuales no protegen adecuadamente a los arrendatarios<\/strong>, por lo que sugieren una serie de propuestas para revertir esta situaci\u00f3n.<\/p>\n<p>En primer lugar, propone que los <strong>contratos sean de al menos tres a\u00f1os para impulsar el arraigo<\/strong>, ya que actualmente la norma es de s\u00f3lo un a\u00f1o; esta disposici\u00f3n se aplicar\u00e1 a menos que las partes no se pongan de acuerdo por otra duraci\u00f3n. Adem\u00e1s, si los arrendadores son due\u00f1os de m\u00e1s de 10 inmuebles, deber\u00e1n establecer contratos de hasta cinco a\u00f1os.<\/p>\n<p>Con contratos m\u00e1s largos, ser\u00eda posible <strong>establecer un tope en el aumento anual del precio de la renta conforme a la inflaci\u00f3n<\/strong>, como prev\u00e9 el C\u00f3digo Civil. Por ahora, muchos propietarios cambian a los inquilinos cada a\u00f1o para no respetar la ley.<\/p>\n<p>Otra de las propuestas es el <strong>registro obligatorio del contrato y la imposici\u00f3n de sanciones<\/strong>. Por otro lado, para evitar abusos, HIC-AL sugiere establecer de manera legal la posibilidad de pedir \u00fanicamente un m\u00e1ximo de una mensualidad como dep\u00f3sito y s\u00f3lo una garant\u00eda. Adem\u00e1s, el dep\u00f3sito debe ser devuelto al inquilino al finalizar el contrato, siempre que no haya provocado da\u00f1os o haya cubierto todas sus mensualidades.<\/p>\n<p>Para fomentar el arraigo, la coalici\u00f3n solicita la <strong>revisi\u00f3n del derecho de preferencia<\/strong>. Este derecho establece que, <strong>si el arrendador desea vender el inmueble, debe ofrecerlo primero al arrendatario<\/strong>, lo que impulsar\u00e1 su permanencia y detendr\u00e1 los desalojos.<\/p>\n<p>Finalmente, HIC-AL propone que las viviendas vac\u00edas por m\u00e1s de cinco a\u00f1os se incorporen a un <strong>Programa de Alquiler Social para grupos prioritarios<\/strong>. La renta deber\u00e1 ser pagada al due\u00f1o, pero el monto no podr\u00e1 superar el 30% de los ingresos del arrendatario.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>HIC-AL propone generar
