{"id":156476,"date":"2025-07-17T13:12:47","date_gmt":"2025-07-17T19:12:47","guid":{"rendered":"https:\/\/centrourbano.com\/revista\/?p=156476"},"modified":"2025-07-17T13:30:17","modified_gmt":"2025-07-17T19:30:17","slug":"reforma-a-la-ley-antilavado-impone-nuevas-obligaciones-al-sector-inmobiliario","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/inmobiliario\/reforma-a-la-ley-antilavado-impone-nuevas-obligaciones-al-sector-inmobiliario\/","title":{"rendered":"Reforma a la Ley Antilavado impone nuevas obligaciones al sector inmobiliario"},"content":{"rendered":"<p>La LFPIORPI modifica de forma sustancial las obligaciones de cumplimiento para desarrolladores, constructores, brokers y fondeadores de proyectos inmobiliarios<!--more--><\/p>\n<p>A partir del 17 de julio de 2025 entran en vigor reformas significativas a la Ley Federal para la Prevenci\u00f3n e Identificaci\u00f3n de Operaciones con Recursos de Procedencia Il\u00edcita (LFPIORPI) que transforman las obligaciones de cumplimiento en materia antilavado para empresas inmobiliarias, incluyendo constructores, desarrolladores, brokers, as\u00ed como de proyectos inmobiliarios.<\/p>\n<p>El objetivo de la reforma es combatir delitos de operaciones con recursos de procedencia il\u00edcita. Por lo que, dentro de las principales modificaciones se incluyen y definen diversas actividades clasificadas como vulnerables. Por ejemplo, se incorpora la <strong>recepci\u00f3n de recursos destinados a desarrollos inmobiliarios con fines de venta o renta<\/strong>.<\/p>\n<p>Tambi\u00e9n se incorporan conceptos como beneficiario controlador, cliente o usuario, persona pol\u00edticamente expuesta, representante encargado de cumplimiento y riesgo. Adem\u00e1s, se establece la <strong>obligaci\u00f3n de recabar documentaci\u00f3n y realizar investigaciones<\/strong> durante los procesos, con el fin de esclarecer el origen de los recursos.<\/p>\n<h2>Nuevas obligaciones del sector inmobiliario<\/h2>\n<p>Entre los cambios m\u00e1s relevantes a la Ley Antilavado destacan:<\/p>\n<ul>\n<li><strong>Conocimiento directo obligatorio del cliente<\/strong>, incluyendo compradores, inversionistas y fondeadores. Ya no bastar\u00e1 s\u00f3lo con identificarlos, tambi\u00e9n se deber\u00e1 verificar de manera activa su informaci\u00f3n y actividad econ\u00f3mica.<\/li>\n<li><strong>Documentaci\u00f3n obligatoria del beneficiario controlador<\/strong>, tanto para personas morales como f\u00edsicas, eliminando la pr\u00e1ctica de aceptar \u00fanicamente declaraciones.<\/li>\n<li><strong>Nueva actividad vulnerable<\/strong>: La recepci\u00f3n de recursos que se destinen para llevar a cabo un desarrollo inmobiliario para venta o renta, cuando el monto sea igual o mayor a 8,025 UMAs.<\/li>\n<li><strong>Reportes obligatorios en un plazo m\u00e1ximo de 24 horas<\/strong> en caso de sospecha de operaciones con recursos de procedencia il\u00edcita, incluso si la operaci\u00f3n no se concreta.<\/li>\n<li><strong>Exclusi\u00f3n de aviso<\/strong> para primeras ventas, siempre que los recursos provengan de instituciones de Banca de Desarrollo u organismos p\u00fablicos de vivienda.<\/li>\n<li>Capacitaci\u00f3n inmediata de personal, <strong>revisi\u00f3n urgente de todas las operaciones<\/strong>, redise\u00f1o de procesos operativos para adoptar los cambios.<\/li>\n<li><strong>Conservaci\u00f3n de informaci\u00f3n durante al menos 10 a\u00f1os<\/strong>, incluyendo correspondencia comercial, an\u00e1lisis previos y registros de reconstrucci\u00f3n.<\/li>\n<\/ul>\n<p>A partir del <strong>17 de julio de 2025, comienzan a aplicarse <\/strong>las nuevas obligaciones y el periodo de observancia. El <strong>17 de agosto de 2025 es la fecha l\u00edmite para presentar el primer aviso<\/strong> conforme al nuevo marco legal. En<strong> julio de 2026 vence el plazo para emitir las nuevas reglas<\/strong> generales y posiblemente entren en vigor obligaciones diferidas, como auditor\u00edas y monitoreo
