{"id":152154,"date":"2024-12-06T09:00:18","date_gmt":"2024-12-06T15:00:18","guid":{"rendered":"https:\/\/centrourbano.com\/revista\/?p=152154"},"modified":"2024-12-06T01:01:22","modified_gmt":"2024-12-06T07:01:22","slug":"nueva-regulacion-renta-breve-hic-al","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/vivienda\/nueva-regulacion-renta-breve-hic-al\/","title":{"rendered":"Nueva regulaci\u00f3n en CDMX no afecta a la renta breve: HIC-AL"},"content":{"rendered":"<p><em>La modificaci\u00f3n a la Ley proh\u00edbe que se alquile una propiedad mediante plataformas de renta breve por m\u00e1s del 50% de las noches del a\u00f1o<\/em><!--more--><\/p>\n<p>Recientemente, se public\u00f3 un estudio titulado \u2018<a href=\"https:\/\/acrobat.adobe.com\/id\/urn:aaid:sc:VA6C2:2db4dcbf-68fc-4b0f-ac5a-b7af1c544145\" target=\"_blank\" rel=\"noopener\"><strong>Estancia Tur\u00edstica Eventual y Plataformas Digitales de Hospedaje en la CDMX<\/strong><\/a>\u2019, que tiene el objetivo de cuestionar los argumentos que relacionan a las <strong>plataformas de renta breve<\/strong> con la problem\u00e1tica de la <strong>gentrificaci\u00f3n<\/strong> y el <strong>encarecimiento de la vivienda<\/strong> en la capital del pa\u00eds.<\/p>\n<p>Dicho documento afirma que estas plataformas han transformado la <strong>oferta del sector tur\u00edstico de la Ciudad de M\u00e9xico<\/strong> de manera disruptiva, aportando ingresos importantes al PIB nacional.<\/p>\n<p>Adem\u00e1s, indica que la operaci\u00f3n de plataformas como Airbnb ha sido regulada en varias ciudades del mundo, como recientemente en la CDMX, con efectos que m\u00e1s que ordenar han contribuido a la <strong>proliferaci\u00f3n de un mercado negro de alquiler<\/strong>.<\/p>\n<p>Sin embargo, la <strong>Coalici\u00f3n Internacional para el H\u00e1bitat- Am\u00e9rica Latina<\/strong> (<strong>HIC-AL<\/strong>) se\u00f1al\u00f3 que el estudio ofrece una narrativa err\u00f3nea sobre la situaci\u00f3n de la vivienda en la capital.<\/p>\n<p>La organizaci\u00f3n asegur\u00f3 que la <a href=\"https:\/\/centrourbano.com\/revista\/vivienda\/nuevas-regulaciones-airbnb-cdmx\/\" target=\"_blank\" rel=\"noopener\"><strong>nueva regulaci\u00f3n de las plataformas<\/strong> <strong>de renta temporal<\/strong><\/a>, derivada de una reforma a la Ley de Turismo de la CDMX, no genera las afectaciones que denuncia el estudio.<\/p>\n<p>Esta modificaci\u00f3n establece que qui\u00e9n alquile una propiedad a trav\u00e9s de una <strong>plataforma de renta breve<\/strong> no lo podr\u00e1 hacer por m\u00e1s del 50% de las noches del a\u00f1o, ya que, de lo contrario, podr\u00eda ser excluido del padr\u00f3n de anfitriones. Esto considerando que las autoridades han evaluado las <strong>afectaciones de las rentas breves<\/strong> en el <strong>derecho a la vivienda<\/strong> y buscan incentivar el <strong>alquiler residencial<\/strong>.<\/p>\n<p>\u201cA\u00fan as\u00ed, este tope interesa s\u00f3lo al <strong>17% de los anfitriones<\/strong>, en su mayor\u00eda empresas especializadas. Esto est\u00e1 en l\u00ednea con el hecho que, para junio del 2023, el 66% de los anfitriones se enlistan en la plataforma con dos, tres o m\u00e1s viviendas, mientras que el 34% restante se registran como oferentes \u00fanicos, lo que pone en entredicho el mito de que la plataforma impulsa la econom\u00eda colaborativa beneficiando al peque\u00f1o propietario, sobre la cual el estudio se sustenta\u201d, indic\u00f3 <strong>HIC-AL<\/strong>.<\/p>\n<p>Asimismo, el estudio sostiene que las plataformas de renta temporal han tenido un m\u00ednimo impacto en el mercado de vivienda capitalino. No obstante, <strong>HIC-AL<\/strong> se\u00f1al\u00f3 que, incluso desde antes de la pandemia, se han denunciado numerosos desalojos relacionados con las rentas breves.<\/p>\n<p>De igual manera, mencion\u00f3 que lo anterior no resulta sorpresivo, pues, seg\u00fan <strong>Inside Airbnb<\/strong>, las viviendas en renta tradicional que se han perdido para destinarse al alquiler de corto plazo han sido 336 s\u00f3lo en la alcald\u00eda Cuauht\u00e9moc; adem\u00e1s de que el <strong>precio<\/strong> <strong>promedio <\/strong>de una vivienda de ese tipo casi triplica las rentas tradicionales, de acuerdo con datos de Inmuebles24.<\/p>\n<p>\u201cNo puede minimizarse el impacto de las plataformas se\u00f1alando que hay otros problemas. El estudio plantea que las plataformas no son el \u00fanico factor que impide el <strong>acceso a la vivienda<\/strong>. Seguramente la problem\u00e1tica es multifactorial y sus causas son profundas, pero es inadmisible negar la relevancia de una de ellas argumentando que existen otras\u201d, expuso.<\/p>\n<p>\u201cLa <strong>crisis de la vivienda<\/strong> es tan profunda que la legislaci\u00f3n existente, primero que nada, debe ser implementada y evaluada por las autoridades en su aplicaci\u00f3n real. Lo que debe privilegiarse es el derecho a la vivienda y a la ciudad de la poblaci\u00f3n junto al di\u00e1logo con otras ciudades progresistas que han encontrado v\u00edas para controlar el
