{"id":131780,"date":"2022-07-05T09:00:28","date_gmt":"2022-07-05T14:00:28","guid":{"rendered":"https:\/\/centrourbano.com\/?p=131780"},"modified":"2022-07-04T23:56:21","modified_gmt":"2022-07-05T04:56:21","slug":"ley-infonavit-derechohabientes","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/vivienda\/ley-infonavit-derechohabientes\/","title":{"rendered":"Proponen reformar Ley del Infonavit para proteger a derechohabientes"},"content":{"rendered":"<p><em>La diputada Lilia Aguilar recalc\u00f3 la necesidad de proteger de fraudes a los derechohabientes del Infonavit que han incurrido en moratoria de pago <\/em><!--more--><\/p>\n<p>La <strong>diputada federal <a href=\"https:\/\/centrourbano.com\/vivienda\/lilia-aguilar-reforma-vivienda\/\" target=\"_blank\" rel=\"noopener\">Lilia Aguilar Gil<\/a><\/strong>, <strong>presidenta de la <a href=\"https:\/\/web.diputados.gob.mx\/\" target=\"_blank\" rel=\"noopener\">Comisi\u00f3n de Vivienda<\/a><\/strong>, present\u00f3 una iniciativa para reformar el art\u00edculo 49 de la <strong>Ley del<\/strong> <strong>Instituto del Fondo Nacional de Vivienda para los Trabajadores<\/strong> (<strong>Infonavit<\/strong>).<\/p>\n<p>Lo anterior, con el objetivo de proteger contra <strong>fraudes<\/strong> y <strong>abusos<\/strong> a los derechohabientes que, por alguna circunstancia, han incurrido en moratoria de pago de su hipoteca.<\/p>\n<p>La legisladora destac\u00f3 la importancia de aplicar medidas para no afectar a las familias mexicanas que, con gran esfuerzo y trabajo, adquieren un cr\u00e9dito del Infonavit para conseguir un hogar.<\/p>\n<p>Asimismo, <strong>Aguilar<\/strong> recalc\u00f3 la necesidad de generar mecanismos para garantizar que, en caso de existir un atraso en el pago, el derechohabiente ser\u00e1 notificado en tiempo y forma sobre el inicio del <strong>proceso administrativo de rescisi\u00f3n y vencimiento del plazo para el pago <\/strong>por parte del Infonavit; as\u00ed como la resoluci\u00f3n que corresponda.<\/p>\n<p>\u201cUna vez con el resultado emitido, el Instituto acudir\u00e1 ante la autoridad judicial competente m\u00e1s cercana al domicilio del inmueble para efecto de iniciar el debido proceso en contra del acreditado; y as\u00ed garantizar que este pueda defenderse\u201d, se\u00f1al\u00f3 la congresista.<\/p>\n<p>En ese sentido, <strong>Aguilar Gil<\/strong> detall\u00f3 que los deudores o quienes ocupen la vivienda deber\u00e1n desocuparla en un t\u00e9rmino de 45 d\u00edas naturales; mismos que se contar\u00e1n a partir de la fecha en que reciba el aviso respectivo. En tanto, el Infonavit podr\u00e1 solicitar que se desocupe el inmueble solamente con la resoluci\u00f3n judicial; por lo tanto, ser\u00e1 el juzgador quien d\u00e9 el plazo para
