{"id":109246,"date":"2020-07-14T11:00:15","date_gmt":"2020-07-14T16:00:15","guid":{"rendered":"https:\/\/centrourbano.com\/?p=109246"},"modified":"2020-07-14T15:58:46","modified_gmt":"2020-07-14T20:58:46","slug":"reforma-arrendamiento-cdmx-adi","status":"publish","type":"post","link":"https:\/\/centrourbano.com\/revista\/vivienda\/reforma-arrendamiento-cdmx-adi\/","title":{"rendered":"Reforma en arrendamiento CDMX, incentivo negativo para la renta institucional: ADI"},"content":{"rendered":"<p><em>La iniciativa disminuir\u00eda la oferta de vivienda en renta debido al alto nivel de riesgo que implicar\u00eda el arrendar, dijo el organismo <\/em><!--more--><\/p>\n<p>La propuesta de <strong>reforma al c\u00f3digo civil de la Ciudad de M\u00e9xico<\/strong> en materia de <strong>arrendamiento inmobiliario<\/strong>, traer\u00eda un efecto de <strong>desincentivaci\u00f3n<\/strong>. Y es que, de concretarse, la iniciativa supondr\u00eda una serie de elementos que generar\u00edan\u00a0<strong>incertidumbre para la renta de vivienda.\u00a0<\/strong><\/p>\n<p>As\u00ed lo consideraron empresarios del sector. Espec\u00edficamente, destacaron que las reformas planteadas se traducir\u00edan en medidas de <strong>restricci\u00f3n de dominio<\/strong> y <strong>denegaci\u00f3n de justicia<\/strong>, lo que frenar\u00eda la inversi\u00f3n para el desarrollo de un mercado de vivienda institucional. Principalmente, dijeron, ante el riesgo que implicar\u00eda arrendar una propiedad.<\/p>\n<p>Al respecto, <strong><a href=\"https:\/\/www.facebook.com\/portalcentrourbano\/videos\/1125304181179359\/?v=1125304181179359\" target=\"_blank\" rel=\"noopener noreferrer\">Mar\u00eda Jos\u00e9 Fern\u00e1ndez<\/a><\/strong>, directora general de la <strong>Asociaci\u00f3n de Desarrolladores Inmobiliario<\/strong> (ADI), expuso que la reforma <strong>traer\u00e1 incertidumbre jur\u00eddica<\/strong>. Al participar en el Foro \u201c<strong>Vivienda y Arrendamiento en tiempos de Covid-19<\/strong>\u201d, subray\u00f3 que la iniciativa ser\u00e1 un incentivo negativo, al no otorgar los elementos para que un propietario puede hacer valer su posesi\u00f3n.<\/p>\n<p>[quote]\u201cAdvertimos de la iniciativa, principalmente, un efecto de desincentivaci\u00f3n de la vivienda en renta. La iniciativa se traducir\u00eda en medidas de restricci\u00f3n de dominio, de negaci\u00f3n de justicia y eventualmente la promoci\u00f3n de inversiones; vulneraci\u00f3n del eficacia en las sentencias, iniquidad contractual e incertidumbre jur\u00eddica\u201d, indic\u00f3.[\/quote]<\/p>\n<h4>Posici\u00f3n<\/h4>\n<p>Durante el foro organizado por el<strong> Congreso CDMX<\/strong>, Mar\u00eda Jos\u00e9 Fern\u00e1ndez fij\u00f3 postura a nombre no s\u00f3lo de ADI, sino tambi\u00e9n de la <strong>Asociaci\u00f3n de Vivienda en Renta<\/strong> (AVER) y de la <strong>C\u00e1mara Nacional de la Industria de Desarrollo y Promoci\u00f3n de Vivienda<\/strong> (Canadevi) Valle de M\u00e9xico. La representante empresarial sostuvo que la reforma supondr\u00eda un freno a la creaci\u00f3n de vivienda en alquiler.<\/p>\n<p>Incluso, dijo, l<strong>a propuesta va en contra del planteamiento realizado por la jefa de Gobierno<\/strong>, Claudia Sheinbaum. Y es que, cabe recordar que la Jefa del Ejecutivo busca impulsar el desarrollo de vivienda en renta social a trav\u00e9s del <strong>Programa de Regeneraci\u00f3n Urbana y Vivienda Incluyente<\/strong>.<\/p>\n<p>\u201cLa <a href=\"https:\/\/centrourbano.com\/2020\/07\/09\/diputados-iniciativa-conflictos-inquilinarios\/\" target=\"_blank\" rel=\"noopener noreferrer\">iniciativa<\/a> es incluso contraria a la pol\u00edtica impulsada por el gobierno de la Ciudad de M\u00e9xico liderado por la doctora Claudia Sheinbaum.
